Terms and Conditions
By submitting a payment (deposit or full payment) or otherwise engaging with JTravelUp Agency LLC (“the Company”), you acknowledge and agree to be bound by these Terms and Conditions. You further understand and agree that JTravelUp acts solely as an independent travel planner and booking agent on your behalf, and is not the provider of travel services, accommodations, transportation, or amenities. Accordingly, you agree to hold JTravelUp Agency LLC harmless from any liability, loss, claim, damage, delay, or injury arising from or related to the actions, omissions, or performance of any travel supplier, including but not limited to airlines, cruise lines, hotels, transportation companies, tour operators, or other vendors. In the event that any issue, dispute, claim, dissatisfaction, or request for restitution arises from the services provided by a supplier, you agree that such matters must be pursued solely and directly with the applicable supplier, and not with JTravelUp Agency LLC. The Company’s responsibility is limited to facilitating reservations and payments as provided by the supplier, and it assumes no responsibility for the supplier’s acts, errors, delays, cancellations, changes, or failures to perform.
PLEASE READ CAREFULLY
The purchase of any services offered by JTravelUp Agency, LLC (JTravelUp) constitutes a contractual arrangement between you (the Traveler) and JTravelUp and represents your acceptance of the Terms & Conditions set out herein. Please ensure that you read carefully and understand these Terms & Conditions prior to booking. You are advised to check our website (www.JTravelUp.com) or to request the latest version of the Terms & Conditions prior to booking your vacation.
DEPOSIT & FINAL PAYMENT
A non-refundable deposit is required to reserve space for you, with some limited exceptions as noted below. Visa, MasterCard, Discover, American Express, Square and PayPal transactions are accepted. In the event the traveler is unable to travel (for whatever reason), the deposit plus other payments are non-refundable and non-transferable. We do recommend getting travel insurance. Your booking is not confirmed and payment is not deemed made until the deposit is received. Your reservation will be automatically canceled if full payment is not received by the final payment date and funds paid are non-refundable and non-transferable. Payment of the deposit indicates you have read and accepted these Terms and Conditions. The Traveler who has selected the monthly payment/automatic charge cannot miss a payment. If payments are missed we reserve the right to charge you a late fee. Two missed payments or charge back will require us to cancel the traveler(s) reservation(s) and all payments made are non-refundable and non-transferable. Please Note: All credit card charge backs will be aggressively pursued, and any fees incurred in the process will be passed over to you; the client. You must notify us via email at JFord@JTravelUp.com at least seven (7) days in advance of your auto draft to request a payment modification.
AGENT
JTravelUp (or any of its affiliated entities) acts as a travel planner only. We sell various travel related products on behalf of numerous transport and accommodation service providers, such as, and not limited to airlines, coach, rail, cruise line operators and hotels. JTravelUp obligations to you are to make travel bookings on your behalf and to arrange relevant contracts between you and the travel service providers. We have no responsibility for these services, nor do we have the authority to make any warranty or representation regarding their standard. A request cannot be guaranteed. All bookings are subject to the terms and conditions, and limitations of liability imposed by these service providers. You understand that your legal recourse is against the specific provider not JTravelUp (or any of its affiliated entities).
LIABILITY
We always do our best to make sure your travel arrangements are satisfactory. However, we cannot accept any liability of whatever nature, whether in contract, tort or otherwise for the acts, omissions or default, whether negligent or otherwise, of these service providers, over whom we have no direct or indirect control. Under circumstances where liability cannot be excluded, such liability is limited to the value of the purchased travel arrangements. We are not liable for any consequential loss or damage. We do not accept any liability in contract, tort or otherwise for any injury, damage, loss, delay, additional expense or inconvenience caused directly or indirectly by force majeure or any other event which is beyond our control or which is not preventable by reasonable diligence on our part.

Elements of our website (www.JTravelUp.com) are protected by copyright, trade and other laws and may not be copied or imitated whole or in part. No logo, graphic, sound, image, or html coding from our website may be copied, altered, or retransmitted unless expressly permitted by JTravelUp. JTravelUp makes no representations about the suitability of the information contained in the pages and related graphics published on this website for any purpose. Such documents are provided “As is” without warranty of any kind.
In no event shall JTravelUp including its owners, representatives, affiliates, or providers (collectively, the “Covered parties”), be liable for any injury, death, loss, claim, damage, act of god, accident, delay, or any special, exemplary, punitive, incidental or consequential damages of any kind, whether based in contract, tort or otherwise, which arise out of or are in any way connected with use of www.JTravelUp.com or with any delay or inability to use the site, or for any information, software, products or services obtained through this site, even if JTravelUp has been advised of the possibility of such damages.
INITIAL DEPOSITS AND PAYMENTS
You will be required to pay a deposit or full payment when booking. All deposits are non-refundable and non-transferable. Final payment is required no later than four (4) weeks prior to departure unless otherwise stated. Some airfares or services must be paid in full at the time of booking.
TRAVEL INSURANCE
Travel Insurance is strongly recommended. The purchase of optional travel insurance that protects you against potential losses is highly recommended. It can be purchased from various suppliers at the time of travel arrangements are made. Review the coverage and policies carefully. It is your responsibility to purchase coverage. You agree to hold JTravelUp blameless if you do or do not purchase travel insurance.
PASSPORTS
If Passports are required they should be valid for more than 6 months after the date of departure from your booked travel arrangements.It is your responsibility to ensure that you have valid travel documentation, including but not limited to passports and visas, which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be your sole responsibility.
NON REFUNDABLE
It should be noted that JTravelUp carries a Non Refundable policy.
NON TRANSFERABLE
It should be noted that documents issued are non-transferable. Such documents may include but are not limited to, airline tickets, hotel vouchers, tour vouchers or any other document used to confirm an arrangement with a service provider. Such documents may also be subject to conditions such as, but not limited to, being non-refundable, non-date-changeable, and subject to cancellation or amendment fees.
CREDIT CARD TRANSACTIONS
If for any reason, any travel service provider is unable to provide the services for which you have contracted, your remedy lies against the provider, and not against JTravelUp and in the event that payment has been made to JTravelUp by credit card, you agree that you will not seek to charge back your payment to JTravelUp. All credit card charge backs will be aggressively pursued and any fees incurred in the process will be passed over to you; the client. If the credit card is declined, you guarantee that you will settle any amounts owing to JTravelUp via money order, or certified check.
PRICE VARIATIONS
We reserve the right to vary published fares in the event of fluctuations in the exchange rate or price increases made by service providers. All rates are per person based on double occupancy, subject to availability at the time of booking, and my increase without notice. Airfare, air taxes, transfers, government fees and taxes are additional unless otherwise stated. In the event of a pricing error, or any other misrepresentation or omission, we reserve the right to adjust the pricing or make any other corrections.
TAXES AND BAGGAGE FEES
Baggage allowance and restrictions will apply on all airlines. These will vary and you should contact the airline you are travelling for the specific restrictions. Some airlines may charge fees for checked baggage. Please note that additional airport fees and government taxes may not be included in your ticket prices, these are collected at destination.
TRAVEL DOCUMENTS
You will receive travel documents no later than approximately 1-2 weeks prior to the departure date. When you receive your Travel Documents, it is the sole responsibility of the passenger named to review and verify all information. Contact JTravelUp immediately if changes or correction are required.
CANCELLATION
Please be aware that most travel bookings are non-refundable and non-transferable. Cancelled bookings will incur charges. These charges can be up to 100% of the cost of the booking, regardless of whether travel has commenced. Where we incur any liability for a cancellation fee or charge for any booking, which you cancel, you agree to indemnify us for the amount of that fee or charge.
CANCELLATION OR SUBSTITUTION BY US
We will make commercially reasonable efforts to keep the Itinerary as it has been published; however, the final Itinerary may vary due to availability and factors beyond our control. We may in our sole discretion substitute services such as hotels or goods of similar quality for any service or good stated in the Itinerary.
We reserve the right to cancel any Tour because of inadequate enrollment that makes the trip economically infeasible to operate or because of our concerns with respect to the safety, health or welfare of our travelers or staff. We will not cancel a Tour without suggesting other travel dates. In an event that our suggested travel dates do not work for you; you will have fourteen (14) days in writing to provide us dates that do. Fail to do so, we reserve the right to adhere to our Non-Refundable, Non-Transferable cause. Our liability is limited to a no refund of your payments to us and we will not be liable for any other costs, damages or refunds of any kind for any loss, delay, inconvenience, disappointment or expense whatsoever in such circumstances. If a Tour in progress must be interrupted or canceled, our liability shall be strictly limited to refund of the recoverable cost of any unused portion of the Tour.
HEALTH AND SPECIAL REQUIREMENTS
It is your responsibility to ensure you are aware of any health requirements for your travel destinations and to ensure that you carry all necessary vaccination documentation. Please advise us of any special requirements you may have, for example, special meals, medical requirements and so on.
REFUSAL OF SERVICE
Service providers reserve the right to refuse service to travelers for any of the following reasons: The traveler:
Lacks proper documentation for the country of destination
Has a contagious disease
Is under the influence of alcohol, drugs or narcotics
Manifests disruptive and/or unruly behavior.
PHOTOGRAPH/VIDEO
JTravelUp reserves the right to use any photograph/video taken at any event or during any travel activity, without the express written permission of those included within the photograph/video. JTravelUp may use the photograph/video in publications or other media material produced, used or contracted by JTravelUp, including but not limited to: brochures, invitations, books, newspapers, magazines, television, websites, etc. Any person desiring not to have their photo taken or distributed must contact JTravelUp in writing at 1714 Franklin St. #100-116, Oakland, CA 94612 of his/her intentions and include a photograph.
PRIVACY POLICY
JTravelUp and its affiliates are committed to protecting the privacy and confidentiality of personal information. We do not share or sale said information.
ALTERNATIVE DISPUTE RESOLUTION
If a dispute, controversy or claim arising out of or relates to this contract, Terms and Conditions, or breach thereof, the parties agree that said dispute shall be submitted to mediation administered by the World Travel Dispute Center, Inc.
RESERVATION OF RIGHTS: CHANGES TO THESE TERMS
JTravelUp reserves the right, in our sole discretion, to change these terms, conditions, and any other notices under which this website is offered and you agree to accept and be bound by those terms, conditions, and notices that are in effect at the time of your use of this website, booked travel with JTravelUp and associated facilities. Updated versions of the Terms will be posted on our website and are effective immediately on posting. Please check frequently, especially before you use our website, to see if these Terms changed. Use of the website after any changes to the Terms constitutes your consent to the changes.
PARTICIPANT CONDUCT EXPECTATIONS JTravelUp LLC and or its travel groups (“the Company”) is committed to creating a safe, respectful, and positive environment for all travelers. By booking a trip or participating in any group event, all travelers agree to conduct themselves in a manner that is courteous, cooperative, and non-disruptive. PROHIBITED CONDUCT The Company reserves the right to address and take action regarding any behavior that, in its sole discretion, is determined to be inconsistent with a positive and safe group experience. This includes, but is not limited to: *Harassing, aggressive, hostile, or disrespectful communication (written or verbal) *Behavior that undermines group cohesion, safety, or well-being *Conduct that creates unnecessary conflict, tension, or disruption *Abusive or accusatory messages directed toward Company staff, contractors, or fellow travelers *Repeated failure to follow instructions, deadlines, payment terms, or communication processes *Any behavior that damages, or has the potential to damage, the Company’s reputation or relationship with suppliers, cruise lines, or vendors RIGHT TO REMOVE A PARTICIPANT The Company may, at its discretion: 1. Issue a written warning; 2. Restrict a traveler’s participation in group-sponsored activities, private events, meetups, or gatherings; 3. Remove a traveler from the group portion of a trip entirely; or 4. Cancel the traveler’s participation in the trip if conduct presents a safety or reputational risk. These actions may be taken with or without prior warning, depending on the severity of the conduct.
IMPACT ON RESERVATION If a traveler is removed from group activities or events: *Their cruise, flight, or hotel reservation (if booked through a supplier such as a cruise line) will remain valid unless canceled by the supplier; *No refund will be issued by the Company for missed group events, meetups, amenities, or experiences; *Additional fees may apply if alternative arrangements need to be made. If a traveler’s entire trip is canceled due to conduct violations, all cancellation penalties outlined by the supplier(s) and the Company will apply. COMMUNICATION STANDARDS All travelers are expected to communicate in a professional, respectful manner. Excessive complaints, hostile tone, accusatory messages, or misuse of escalation channels (including contacting suppliers with misleading or defamatory claims) may be considered disruptive conduct. SUPPLIER RELATIONSHIPS The Company maintains formal partnerships with travel suppliers. Any communication by a traveler that threatens these relationships, includes false statements, or attempts to involve suppliers in disputes that should be handled internally may constitute grounds for removal. FINAL AUTHORITY The Company has full discretion to interpret this policy and determine appropriate action. Decisions regarding removal are final.
GOVERN OF THESE TERMS AND CONDITIONS
The laws of the state of Delaware, USA, govern these Terms and Conditions. You hereby consent to the exclusive jurisdiction and venue of the courts in Delaware, USA, in all disputes arising out of or relating to travel bookings with JTravelUp, including the use of the JTravelUp website. The use of JTravelUp website is unauthorized in any jurisdiction that does not given effect to all provisions of these terms and conditions, including, without limitation, this paragraph.
